Einer der traditionell gegen den Utilitarismus erhobenen Vorwürfe besagt, Utilitarismus sei mit der Konzeption unveräußerlicher Individualrechte unvereinbar, er könne die Menschenrechte entweder nicht begründen oder schlösse deren Gebotensein schlicht aus. Der Berechtigung dieser Behauptung wird zuerst bei den klassischen Utilitaristen Jeremy Bentham und John Stuart Mill nachgegangen. Der Einwand von Bernhard Williams gegen den Utilitarismus, er würdige den Wert von Integrität der Persönlichkeit nicht, wird anhand seines von ihm selbst gebotenen Beispiels erwogen. Unter den nicht-klassischen Utilitarismen wird die Theorie von (...) Rainer W. Trapp auf ihre Vereinbarkeit mit unveräußerlichen Rechten geprüft. Das Resümee ist uneindeutig: Nicht alle Utilitarismen schließen die Rechtsinhalte unveräußerlicher Individualrechte aus. The book introduces a conception of discourse ethics, an intersubjectivist version of Kantian ethics. Analysing contributions by Jürgen Habermas, Karl-Otto Apel, Wolfgang Kuhlmann, Albrecht Wellmer, Robert Alexy, Klaus Günther, Rainer Forst, Marcel Niquet and others, it reconstructs critical discussions of the justification of the principle of morality (Part I) and the various proposals for its application (Part II). It defends an alternative model of how discourse ethics can provide guidance in non-ideal circumstances and avoid both arbitrariness and rigorism.

Biological individuality is a notoriously thorny topic for biologists and philosophers of biology. In this paper we argue that biological individuality presents multiple, interconnected questions for biologists and philosophers that together form a problem agenda. Using a case study of an interdisciplinary research group in ecology, behavioral and evolutionary biology, we claim that a debate on biological individuality that seeks to account for diverse practices in the biological sciences should be broadened to include and give prominence to questions about uniqueness (...) and temporality. We show that broadening the problem agenda of biological individuality draws attention to underrecognized philosophical issues and discussions and thereby organizes and enriches the existing debate. In this paper I develop a concept of behavioural ecological individuality. Using findings from a case study which employed qualitative methods, I argue that individuality in behavioural ecology should be defined as phenotypic and ecological uniqueness, a concept that is operationalised in terms of individual differences such as animal personality and individual specialisation. This account make sense of how the term “individuality” is used in relation to intrapopulation variation in behavioural ecology. The concept of behavioural ecological individuality can sometimes be (...) used to identify individuals. It also shapes research agendas and methodological choices in behavioural ecology, leading researchers to account for individuals as sources of variation. Overall, this paper draws attention to a field that has been largely overlooked in philosophical discussions of biological individuality and highlights the importance of individual differences and uniqueness for individuality in behavioural ecology. This paper addresses a relatively new mode of ecological research: data synthesis studies. Data synthesis studies involve reusing data to create a general model as well as a reusable, aggregated dataset. Using a case from movement ecology, I analyse the trade-offs and strategies involved in data synthesis. Like theoretical ecological modelling, I find that synthesis studies involve a modelling trade-off between generality, precision and realism; they deal with this trade-off by adopting a pragmatic kludging strategy. I also identify an additional (...) trade-off, the synthesis trade-off, between making data easy to synthesise for a particular project, on the one hand, and facilitating data reuse for other projects, on the other. In response to this synthesis trade-off, researchers create flexible datasets that are relatively easy to use for particular projects and can be adjusted to suit some other purposes. The flexibility compromise is also found in broader open data efforts, making it a significant element in the future of data-intensive ecology. (shrink)

The chapter deals with misconceptions in perception theory that are based on the idea of slicing the nature of perception along the joints of physics and on corresponding ill-conceived ʹpurposesʹ and ʹgoalsʹ of the perceptual system. It argues that the conceptual structure underlying the percept cannot be inferentially attained from the sensory input. The output of the perceptual system, namely meaningful categories, is evidently vastly underdetermined by the sensory input, namely physico-geometric energy patterns. Thus, the core task of perception theory (...) is to understand the internal conceptual structure with which our perceptual system is endowed. The conceptual structure underlying the semantic distinctions that characterise the output of the perceptual system can, by conceptual necessity, only be expressed by a logical language that is strictly more powerful than the logical language by which sensory notions can be expressed. Consequently, the internal structure underlying perceptual meaning – including core notions such as ‘Gestalt’ or ‘perceptual object’ – cannot be derived, by whatever kind of general inductive machinery, from the sensory input, or, more generally, from experience. This chapter questions the way “sex” features in behavioral ecological research as a standard explanatory variable. Researchers often use sex to explain variation in a trait or phenomenon that they are studying. This practice is widespread, partly because sex is often easy to identify and often explains some variation, thus making it easier to discover and test other causal patterns of interest. Yet, sex also frequently fails to explain variation. Using a couple of recent examples, it is shown how the (...) pervasiveness of sex as an explanatory variable is partly due to the structure of scientific research, including the use of data from large longitudinal studies, and generalization from previous studies. Researchers should more carefully assess and justify the relevance of sex to each new study, to avoid overgeneralization and the perpetuation of assumptions about sexual difference and its importance in biology. The assumptions pertain to the idea that colour is a kind of autonomous and unitary attribute. It is regarded as unitary or homogeneous by assuming that its core properties do not depend on the type of (...) ‘perceptual object’ to which it pertains and that‘colour per se’ constitutes a natural attribute in the functional architecture of the perceptual system. It is regarded as autonomous by assuming that it can be studied in isolation of other perceptual attributes. More generally, the chapter argues on the bases of corresponding empirical and theoretical evidence that perception cannot be understood as the ‘recovery’ of physical world structure from sensory structure by input-based computational processes. Rather, the sensory input serves as a kind of sign for biologically relevant aspects of the external world that activates biologically given conceptual forms with their internal parameters. Although the sensory input is a causally necessary requirement for the activation of conceptual forms, the perceptual computations triggered are under the control of an internal programme based on a set of conceptual forms. Colour is, according to prevailing orthodoxy in perceptual psychology, a kind of autonomous and unitary attribute. It is regarded as unitary or homogeneous by assuming that its core properties do not depend on the type of ‘perceptual object’ to which it pertains and that‘colour per se’ constitutes a natural attribute in the functional architecture of the perceptual system. It is regarded as autonomous by assuming that it can be studied in isolation of other perceptual attributes. These assumptions also provide the (...) pillars for the technical field of colorimetry, and have proved very fruitful for neurophysiological investigations into peripheral colour coding. They also have become, in a technology-driven cultural process of abstraction, part of our common-sense conception of colour. With respect to perception theory, however, both assumptions are grossly inadequate, on both empirical and theoretical grounds. All the same, the idea of an internal homogeneous and autonomous attribute of ‘colour per se’, mostly taken not as an empirical hypothesis but as a kind of truism, became a guiding idea in perceptual psychology. Here, it has impeded the identification of relevant theoretical issues and consequently has become detrimental for the development of explanatory frameworks for the role of ‘colour’ within the structure of our perceptual system. The chapter argues that enquiries into colour perception cannot be divorced from general enquiries into the structure of the conceptual forms underlying perception. (shrink)

Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. The chapter outlines an abstract theoretical framework that is currently (re-)emerging in the course of a theoretical convergence of several disciplines. In the first section, the fundamental problem of perception theory is formulated, namely, the generation, by the perceptual system, of meaningful categories from physicogeometric energy patterns. In the second section, it deals with basic intuitions and assumptions underlying what can be regarded as the current Standard Model of Perceptual Psychology and points out why this model is profoundly inadequate for (...) dealing with the fundamental problem of perception theory. In the third section, it discusses a level of analysis that promises to be fruitful for dealing, in conformity with established procedures of the natural sciences, with the problem of perceptual “meaning” and the problem of what constitutes a “perceptual object.” In the fourth section, it outlines a theoretical perspective on basic principles of the perceptual system which centers on the notions of complex data types and conceptual forms, and draws an entirely different theoretical picture of the role of the sensory input than traditional accounts. The final section focusses on the issue of material qualities and discusses, within the general theoretical framework outlined, some observations and results on the perception of certain material properties, namely, lustrous and glassy appearances. The Information Artifact Ontology (IAO) was created to serve as a domain‐neutral resource for the representation of types of information content entities (ICEs) such as documents, data‐bases, and digital im‐ages. We identify a series of problems with the current version of the IAO and suggest solutions designed to advance our understanding of the relations between ICEs and associated cognitive representations in the minds of human subjects. This requires embedding IAO in a larger framework of ontologies, including most importantly the Mental (...) Func‐tioning Ontology (MFO). It also requires a careful treatment of the aboutness relations between ICEs and associated cognitive representa‐tions and their targets in reality, which implies in turn a new treatment of the relation of truthmaking. It is a characteristic feature of our mental make-up that the same perceptual input situation can simultaneously elicit conflicting mental perspectives. This ability pervades our perceptual and cognitive domains. Striking examples are the dual character of pictures in picture perception, pretend play, or the ability to employ metaphors and allegories. I will argue that traditional approaches, beyond being inadequate on principle grounds, are theoretically ill-equipped to deal with these achievements. I will then outline a theoretical perspective that has been emerging (...) from a theoretical convergence of perceptual psychology, ethology, linguistics, and developmental research. On the basis of this framework, I will argue that corresponding achievements are brought forth by a specific type of functional architecture whose core features are: (i) a perceptual system that is biologically furnished with a rich system of conceptual forms, (ii) a triggering relation between the sensory input and conceptual forms by which the same sensory input can be exploited by different types or systems of conceptual forms, and (iii) computational principles for handling semantically underspecified conceptual forms. Characteristic features of the proposed theoretical framework will be pointed out using the Heider-Simmel phenomenon as an example. (shrink)

The aim of this paper is to introduce, elucidate and defend the usefulness of a variant of grounding, or metaphysical explanation, that has the feature that the grounds explain of some states of affairs that one of them obtains without explaining which one obtains. I will dub this variant arbitrary grounding. After informally elucidating the basic idea in the first section, I will provide three metaphysical hypotheses that are best formulated in terms of arbitrary grounding in the second section. Moral perception has made something of a comeback in recent work on moral epistemology. Many traditional objections to the view have been argued to fail upon closer inspection. But it remains an open question just how far moral perception might extend. In this paper, I provide the beginnings of an answer to this question by assessing the relationship between the metaphysical structure of different normative properties and a plausible constraint on which properties are eligible for perceptual awareness which I call (...) the Counterfactual Strengthening Test. Along the way I consider and reject a few other possible constraints on perceptual awareness. I defend the view that moral perception is restricted to the perception of evaluative and pro tanto deontic properties. I conclude with a few gestures toward what this limitation on moral perception may mean for broader moral epistemology. (shrink)

The chapter deals with the notion of phenomenal realness, which was first systematically explored by Albert Michotte. Phenomenal realness refers to the impression that a perceptual object is perceived to have an autonomous existence in our mind-independent world. Perceptual psychology provides an abundance of phenomena, ranging from amodal completion to picture perception, that indicate that phenomenal realness is an independent perceptual attribute that can be conferred to perceptual objects in different degrees. The chapter outlines a theoretical framework that appears particularly (...) well-suited for dealing with corresponding phenomena. According to this framework, perception can be understood as a triggering of conceptual forms by sensor inputs. It is argued that the attribute of phenomenal realness is based on specific types of internal evaluation functions which deal with the segregation of causes conceived as ‘external’ from those conceived as ‘internal’. These evaluation functions integrate different internal sources of ‘knowledge’ about the potential causes for the activation of conceptual forms and provide markers by which conceptual forms can be tagged as ‘external world objects’. Health Level 7 (HL7) is an organization seeking to provide universal standards for the exchange of healthcare information. In a document entitled ‘HL7 Version 3 Standard: Data Types’, the HL7 organization advances descriptions of data types recom- mended for use as identifiers. We will argue that the descriptions supplied provide insufficient guidance as to what exactly the entities are which these data types uniquely identify. Are they real things, such as persons or pieces of equipment? Or are they representations of (...) such real things in information artifacts? We here outline the problems faced by HL7 in providing answers to such questions, problems which arise because of the lack of anything like a coherent ontology in the HL7 standard, and we make some recommendations for future improvements. This is a big-picture discussion of an important implication of Darwinism for ethics. I argue that there is a misfit between our scientific view of the natural world and the view, still dominant in academic philosophy and wider society alike, that there is a discrete hierarchy of moral status among conscious beings. I will suggest that the clear line of traditional morality – between human beings and other animals – is a remnant of an obsolete moral outlook, not least because (...) it has no counterpart in empirical reality, and I will invite the reader to think, with me, about tenable alternatives. Tracking technology has been heralded as transformative for animal ecology. In this paper I examine what changes are taking place, showing how current animal movement research is a field ripe for philosophical investigation. I focus first on how the devices alter the limitations and biases of traditional field observation, making observation of animal movement and behaviour possible in more detail, for more varied species, and under a broader variety of conditions, as well as restricting the influence of human presence and (...) observer bias. I reconstruct these as shifts in scope, objectivity, accuracy and fruitfulness. The second transformation is slightly less obvious but equally significant for animal ecology. Tracking devices generate complex data that demands both statistical and biological expertise, which has led to increasingly frequent and intensive collaborations between statisticians and biologists. Based on interviews, I examine how researchers in these interdisciplinary collaborations negotiate the collection, analysis and interpretation of movement data, integrating research interests, methodological constraints, previous field observations, and background theory. Tracking technology is therefore also shifting which disciplinary considerations are brought to bear on research into animal movement and behaviour and how this research is conducted. (shrink)

There are few moral convictions that enjoy the same intuitive plausibility and level of acceptance both within and across nations, cultures, and traditions as the conviction that, normally, it is morally wrong to kill people. Attempts to provide a philosophical explanation of why that is so broadly fall into three groups: Consequentialists argue that killing is morally wrong, when it is wrong, because of the harm it inflicts on society in general, or the victim in particular, whereas personhood and human (...) dignity accounts see the wrongness of killing people in its typically involving a failure to show due respect for the victim and his or her intrinsic moral worth. I argue that none of these attempts to explain the wrongness of killing is successful. Consequentialism generates too many moral reasons to kill, cannot account for deeply felt and widely shared intuitions about the comparative wrongness of killing, and gives the wrong kind of explanation of the wrongness of killing. Personhood and human dignity accounts each draw a line that is arbitrary and entirely unremarkable in terms of empirical reality, and hence ill-suited to carry the moral weight of the difference in moral status between the individuals below and above it. Paying close attention to the different ways in which existing accounts fail to convince, I identify a number of conditions that any plausible account of the wrongness of killing must meet. I then go on to propose an account that does. I suggest that the reason that typically makes killing normal human adults wrong equally applies to atypical human beings and a wide range of non-human animals, and hence challenge the idea that killing a non-human animal is normally easier to justify than killing a human being. This idea has persisted in Western philosophy from Aristotle to the present, and even progressive moral thinkers and animal advocates such as Peter Singer and Tom Regan are committed to it. We performed a qualitative analysis of the Thesaurus in order to assess its conformity with principles of good practice in terminology and ontology design. We used both the on-line browsable version of the Thesaurus and its OWL-representation (version 04.08b, released on August 2, 2004), measuring each in light of the requirements put forward in relevant ISO terminology standards and in light of ontological principles advanced in the recent literature. Version 04.08b of the NCI Thesaurus suffers from the same broad range (...) of problems that have been observed in other biomedical terminologies. For its further development, we recommend the use of a more principled approach that allows the Thesaurus to be tested not just for internal consistency but also for its degree of correspondence to that part of reality which it is designed to represent. When does opinion formation within an interacting group lead to consensus, polarization or fragmentation? The article investigates various models for the dynamics of continuous opinions by analytical methods as well as by computer simulations. Section 2 develops within a unified framework the classical model of consensus formation, the variant of this model due to Friedkin and Johnsen, a time-dependent version and a nonlinear version with bounded confidence of the agents. Section 3 presents for all these models major analytical results. Section (...) 4 gives an extensive exploration of the nonlinear model with bounded confidence by a series of computer simulations. Biological individuality is without a doubt a key concept in philosophy of biology. Questions around the individuality of organisms, species, and biological systems can be traced throughout the philosophy of biology since the discipline’s inception, not to mention the sustained attention they have received in biology and philosophy more broadly. It’s high time the topic got its own Cambridge Element. McConwell’s Biological Individuality falls short of an authoritative overview of the debate on biological individuality. Based on the Ontology for General Medical Science, we propose definitions for biomarkers of various types of. These definitions provide not only a complete formal representation of what biomarkers are according to the Institute of Medicine (IOM), but also remove the ambiguities and inconsistencies encountered in the documentation provided by the IOM.

This working paper combines Lukas Schmid’s article “Responding to unauthorized residence: on a dilemma between ‘firewalls’ and ‘regularisations’” with three critical responses as well as a rejoinder by the author. Schmid argues that a set of liberal-democratic commitments gives conscientious policymakers strong reason to implement both so-called ‘firewall’ and ‘regularisation’ policies, thereby protecting unauthorised immigrants’ basic needs and interests and officially incorporating many of them in society. He then explains that the background imperative of immigration control creates a dilemmatic tension (...) between these policies, as regularisation is envisaged alongside the removal of the ineligible, which is in turn hindered by the implementation of firewalls. This creates a dilemma between the pursuit of two policy goals that are both underwritten by the same value commitments. Schmid concludes that the best way to mitigate this dilemma is to design regularisation policy in a way that leaves only a small number of unauthorised immigrants subject to removal. Antje Ellermann’s response reflects critically on Schmid’s understanding of firewalls, arguing that there is good reason to think that the presence of firewalls does not hinder the implementation of removals of unauthorised immigrants who are ineligible for regularisation. She concludes that, contrary to Schmid’s argument, there is no true ethical dilemma between firewall and regularisation policy. Adam Omar Hosein’s contribution argues that the tensions Schmid discusses arise only because of his adoption of widely shared assumptions about the proper basis for regularisation policies. He suggests they can be avoided by adopting a superior justification for regularisations: the ‘autonomy argument.’ In the last response, Cecilia Menjívar reflects on some constraints conscientious policymakers may face when dealing with ethically dilemmatic choices, such as a policy landscape of government agencies with conflicting goals as well as foreign policy and international obligations, all of which are rooted in anti-immigrant backlash and racism around the globe. The working paper concludes with a rejoinder, in which Schmid discusses the contributors’ key points, outlines agreements and disagreements, and explores the bigger picture sketched by the working paper’s discussions. The cognitive neurosciences are based on the idea that the level of neurons or neural networks constitutes a privileged level of analysis for the explanation of mental phenomena. This paper brings to mind several arguments to the effect that this presumption is ill-conceived and unwarranted in light of what is currently understood about the physical principles underlying mental achievements. It then scrutinizes the question why such conceptions are nevertheless currently prevailing in many areas of psychology. The paper argues that corresponding (...) conceptions are rooted in four different aspects of our common-sense conception of mental phenomena and their explanation, which are illegitimately transferred to scientific enquiry. These four aspects pertain to the notion of explanation, to conceptions about which mental phenomena are singled out for enquiry, to an inductivist epistemology, and, in the wake of behavioristic conceptions, to a bias favoring investigations of input–output relations at the expense of enquiries into internal principles. To the extent that the cognitive neurosciences methodologically adhere to these tacit assumptions, they are prone to turn into a largely a-theoretical and data - driven endeavor while at the same time enhancing the prospects for receiving widespread public appreciation of their empirical findings. Digital Rights Management (DRM) covers the description, identification, trading, protection, monitoring and tracking of all forms of rights over both tangible and intangible assets. The Digital Object Identifier (DOI) system provides a framework for the persistent identification of entities involved in this domain. Although the system has been very well designed to manage object identifiers, some important questions relating to the creation and assignment of identifiers are left open. The paradigm of a Referent Tracking System (RTS) recently advanced in the (...) healthcare and life sciences environment is able to fill these gaps. This is demonstrated by pointing out inconsistencies in the existing DOI models and by showing how they can be corrected using an RTS. (shrink)

Let us assume that the basic claim of the belief-desire theory of emotion is true: What, then, is an emotion? According to Castelfranchi and Miceli (2009), emotions are mental compounds that emerge from the gestalt integration of beliefs, desires, and hedonic feelings (pleasure or displeasure). By contrast, I propose that emotions are affective feelings caused by beliefs and desires, without the latter being a part of the emotion. My argumentation for the causal feeling theory proceeds in three steps. First, I (...) argue that affective feelings should be regarded as components of emotions because this assumption provides the best available explanation of the phenomenal character and the intensity of emotional experiences. Second, I examine the two main arguments for regarding beliefs and desires as emotion components—that doing so is needed to explain the finer distinctions among emotions and their object-directedness—and argue that they are unconvincing: Emotions can be distinguished by referring to their cognitive and motivational causes, and their appearance of object-directedness could be an illusion. Third, I present three objections against the hypothesis that beliefs and desires are components of emotions: This hypothesis fails, at second sight, to explain the directedness of emotions at specific objects; it has difficulty accounting for the duration of emotional reactions caused by the fulfillment of desires and the disconfirmation of beliefs; and there are reasons to question the existence of the postulated emotional gestalts and the process that presumably generates them. The causal feeling theory avoids these problems. I therefore recommend abandoning the belief-desire compound theory of the nature of emotions in favor of the causal feeling theory. However, a partial reconciliation of the two theories is possible with respect to the concept of “affectively tinged” thoughts. (shrink)

One important challenge for contingentists is that they seem to be unable to account for the meaning of some apparently meaningful modal discourse that is perfectly intelligible for necessitists. This worry is particularly pressing for higher-order contingentists, contingentists who hold that it is not only contingent which objects there are, but also contingent which semantic values there are for higher-order variables to quantify over. Objections against higher-order contingentism along these lines have been presented in Williamson (Mind 119(475):657–748, 2010; Modal logic (...) as metaphysics, Oxford University Press, 2013, ch. 7), and Fritz and Goodman (Mind 126(504):1063–1108, 2017). This paper presents a way for contingentists to respond to these challenges. The upshot is that the contingentist can account for the meaningfulness of the problematic modal claims by pretending necessitism to be true, but in some cases it turns out to be indeterminate whether they are true. I defend this strategy against the objections against pretence-strategies presented in Fritz and Goodman (Mind 126(504):1063–1108, 2017, §4). Furthermore, I defend the plausibility of the resulting indeterminacy from the contingentist’s perspective. (shrink)

Advances in science and technology have added to our insights into the vulnerabilities of human agency as well as to the methods of exploiting them. This has raised the stakes for efforts to clarify the concept and ethics of manipulation. Among these efforts, Robert Noggle’s influencer-centered account of manipulation has been most significant. He defines manipulative acts as those whereby an agent intentionally influences a recipient’s attitudes so that they do not conform as closely as they otherwise would to the (...) pertinent norms and ideals endorsed by the influencer. This provides a relatively simple and in many ways clear definition of manipulation. It sidesteps thorny debates about autonomy, freedom, or practical rationality. It also promises to reveal a conceptual parallel between manipulating and lying, and thus to explain why manipulation is pro tanto wrong. In one respect, however, the account remains ambiguous: It remains unclear whether, and to what extent, it requires that influencers’ beliefs about what is ideal for their recipients to be grounded in some effort on the part of the influencer to identify with or take on the role of her recipient. This paper explains this ambiguity. It argues that influencer-centrism cannot remain indifferent to the validity of an agent’s beliefs about the ideal state of the recipient and provide an identification requirement that would render the whole account plausible and sufficiently determinate. This paper is a historical, legal and philosophical analysis of the concept of human dignity in German and Kenyan constitutional law. We base our analysis on decisions of the Federal Constitutional Court of Germany, in particular its take on life imprisonment and its 2006 decision concerning the shooting of hijacked airplanes, and on a close reading of the Constitution of Kenya. We also present a dialogue between us in which we offer some critical remarks on the concept of human dignity (...) in the two constitutions, each one of us from his own philosophical perspective. In a recent paper, Tim Henning argues that the result that we should save the greatest number in rescue cases can be established on procedural grounds without making use of the aggregation of interests. He first argues that we ought to respect the affected persons' equal claims to have a say in the rescue decision and that this can only be achieved by the majority rule, which consists in giving each affected person an equal vote. Then he argues for the (...) second claim that if everyone votes in their self-interest, then the greatest number will be saved. I present a class of cases in which the second claim fails. This establishes that even if self-interested voting is assumed, the majority rule does not always lead to the greatest number being saved. (shrink)

In this article, I propose a formal criterion that distinguishes between deductively valid arguments that do and do not beg the question. I define the concept of a Never-failing Minimally Competent Knower (NMCK) and suggest that an argument begs the question just in case it cannot possibly assist an NMCK in extending his or her knowledge.

Modal dispositionalists hold that dispositions provide the foundation of metaphysical necessity and possibility. According to the kind of modal dispositionalism that can be found in the present literature, a proposition p is possible just in case some things are disposed to be such that p. In the first part of this paper I show that combining this classic form of dispositionalism with the assumptions that the laws of nature are necessary and deterministic and that all dispositions are forward-looking in time (...) leads to the unattractive conclusion that every truth is necessary. I argue that the classic dispositionalist should be troubled by this result and in the second part of the paper I suggest a novel variant of dispositionalism that avoids it. This extended form of dispositionalism allows that some propositions are only indirectly underwritten by dispositions. (shrink)

The ongoing digital transformation of almost all areas of human action and agency calls for a readjustment of the norms that regulate these practices. For example, the digitisation of communicative practices poses new challenges to their functioning. This paper explains some of these challenges and argues that they cannot be met by a normative framework that focuses mainly on defensive (free speech and property) rights. In the context of mediated digital communication, the application of such a framework may even have (...) paradoxical consequences. Accordingly, this paper argues for a broader system of communicative rights, understood as rights to meaningful participation in well-functioning communicative practices. (shrink)

This paper develops the metaphysical hypothesis that there are irreducibly collective pluralities, pluralities of objects that do not have a singular object among them. A way to formulate this hypothesis using plural quantification will be proposed and the coherence of irreducibly collective existence will be defended. Furthermore, irreducibly collective existence will be shown to allow for bottomless scenarios that do not involve things standing in relations of parthood. This will create logical space for an anti-atomistic form of mereological nihilism.

Quality assurance in large terminologies is a difficult issue. We present two algorithms that can help terminology developers and users to identify potential mistakes. We demon­strate the methodology by outlining the different types of mistakes that are found when the algorithms are applied to SNOMED-CT. On the basis of the results, we argue that both formal logical and linguistic tools should be used in the development and quality-assurance process of large terminologies.

The goal of referent tracking is to create an ever-growing pool of data relating to the entities existing in concrete spatiotemporal reality. In the context of Electronic Healthcare Records (EHRs) the relevant concrete entities are not only particular patients but also their parts, diseases, therapies, lesions, and so forth, insofar as these are salient to diagnosis and treatment. Within a referent tracking system, all such entities are referred to directly and explicitly, something which cannot be achieved when familiar concept-based systems (...) are used in what is called “clinical coding”. In this paper we describe the components of a referent tracking system in an informal way and we outline the procedures that would have to be followed by healthcare personnel in using such a system. We argue that the referent tracking paradigm can be introduced with only minor – though nevertheless ontologically important – technical changes to existing EHR infrastructures, but that it will require a radically different mindset on the part of those involved in clinical coding and terminology development from that which has prevailed hitherto. Stance-independent nonnaturalist moral realism is subject to two related epistemological objections. First, there is the metaethical descendant of the Benacerraf problem. Second, there are evolutionary debunking arguments. Standard attempts to solve these epistemological problems have not appealed to any particular moral epistemology. The focus on these epistemologically neutral responses leaves many interesting theoretical stones unturned. Exploring the ability of particular theories in moral epistemology to handle these difficult epistemological objections can help illuminate strengths or weaknesses within these theories themselves, as (...) well as opening up potentially unexplored avenues for responding to deeply entrenched concerns about our epistemic access to the moral properties. In this paper, I assess the prospects of an empiricist and perceptualist model of moral knowledge for responding to epistemological arguments against non-skeptical moral realism. I argue that such a view has powerful responses to these objections that are not open to other moral epistemologists. The upshot is that if some version of the view is correct, then the realist has less to fear from Benacerraf and evolutionary debunking–style epistemological objections. Insofar as one is already a committed realist, then, this provides some indirect support for moral perceptualism. (shrink)

PURPOSE—A substantial fraction of the observations made by clinicians and entered into patient records are expressed by means of negation or by using terms which contain negative qualifiers (as in “absence of pulse” or “surgical procedure not performed”). This seems at first sight to present problems for ontologies, terminologies and data repositories that adhere to a realist view and thus reject any reference to putative non-existing entities. Basic Formal Ontology (BFO) and Referent Tracking (RT) are examples of such paradigms. The (...) purpose of the research here described was to test a proposal to capture negative findings in electronic health record systems based on BFO and RT. METHODS—We analysed a series of negative findings encountered in 748 sentences taken from 41 patient charts. We classified the phenomena described in terms of the various top-level categories and relations defined in BFO, taking into account the role of negation in the corresponding descriptions. We also studied terms from SNOMED-CT containing one or other form of negation. We then explored ways to represent the described phenomena by means of the types of representational units available to realist ontologies such as BFO. RESULTS—We introduced a new family of ‘lacks’ relations into the OBO Relation Ontology. The relation lacks_part, for example, defined in terms of the positive relation part_of, holds between a particular p and a universal U when p has no instance of U as part. Since p and U both exist, assertions involving ‘lacks_part’ and its cognates meet the requirements of positivity. CONCLUSION—By expanding the OBO Relation Ontology, we were able to accommodate nearly all occurrences of negative findings in the sample studied. (shrink)

Non-naturalism is the view that normative properties are response-independent, irreducible to natural properties, and causally inefficacious. An underexplored question for non-naturalism concerns the metasemantics of normative terms. Ideally, the non-naturalist could remain ecumenical, but it appears they cannot. Call this challenge the metasemantic challenge. This chapter suggests that non-naturalists endorse an epistemic account of reference determination of the sort recently defended by Imogen Dickie, with some modifications. An important implication of this account is that, if correct, a fully fleshed out (...) moral epistemology will simultaneously rebut metasemantic objections to non-naturalism. Thus, both the metasemantic and the more widely discussed epistemological challenges in effect amount to one. Before setting out the positive view, the chapter considers why all of the traditional metasemantic theories cause trouble for the non-naturalist. This includes discussions of teleosemantics, conceptual role semantics, as well as Schroeter and Schroeter’s “connectedness” model. (shrink)

Der vorliegende Artikel untersucht moderne Mensch-Maschine-Interaktion im Kontext verbreiteter Hard- und Softwareoberflächen und diskutiert davon ausgehend die Frage nach Aufklärung und Gegenaufklärung im digitalen Zeitalter. Er nimmt das Feld des »User Experience Designs« in den Blick - dies ist ein stilprägender Fachdiskurs, in dem verhaltenswissenschaftliche Erkenntnisse und massendatenbasierte Analysen zur Optimierung von Benutzeroberflächen und Interaktionsdesigns eingesetzt werden. Anhand von Beispielstudien wird argumentiert, dass dieser Gestaltung systematisch drei implizite anthropologische Annahmen zugrunde liegen: Nutzerverhalten gilt als durch prä-reflexive Stimuli beeinflussbar; es gilt (...) als statistisch ausmessbar und vorhersagbar; und Nutzer_innen wollen vermeintlich keine Einblicke in die technischen Abläufe hinter den bunten Bedienoberflächen digitaler Dienste erhalten. Die Diagnose der digitalen Entmündigung verweist sodann auf eine Gesamtheit von strukturellen Tendenzen, durch die Individuen der Fähigkeit zur selbstbestimmten Nutzung ihres Verstands in der Interaktion mit digitalen Artefakten beraubt werden. Dieser Band befasst sich mit einem wichtigen Aspekt der Ars didactica: Er diskutiert zwar keine neuen „Übersetzungsmethoden“, will aber dazu anregen, das Übersetzen als eine unverzichtbare Kulturtechnik zu lehren und zu lernen. Er will dazu ermuntern, das Übersetzen nicht auf die informationstheoretischen bzw. nachrichtentechnischen Vorgänge des Rekodierens und Dekodierens zu reduzieren, sondern als eine anspruchsvolle und bisweilen auch kreative Leistung ernst zu nehmen, seine ästhetische Dimension nicht aus den Augen zu verlieren und den Respekt vor dem Original erkennen zu lassen.
